Agreement
Terms and Conditions
1. Conditions of Hire
By hiring Clubhouse and/or Courts, the Hirer agrees that:
• the Terms and Conditions of Hire form a binding agreement between the Hirer and Eildon Croquet Club; and the Hirer will comply with them when using the Clubhouse and/or Courts for the approved purpose.
2. Bookings
2.1 Hours of Use
Event start and finish times will be determined when the booking is made. Amendments permitted.
2.2 Confirmed Bookings
The booking is confirmed upon payment of the required deposit.
3. Hire Fees & Charges
3.1 General
Hire fees are set by the Eildon Croquet Club.
Confirmed bookings will not be affected by any increased hire charges.
Fees for regular hire agreements will be determined in consultation with the Eildon Croquet Club Management Committee.
3.2 Payment in Advance
Casual (one-off event) Hirers agree to pay the balance of the hire either before the event or on the day of the event.
Regular Hirer fees are due one week prior to their booking.
4. Cancellations
4.1 Notification
Eildon Croquet Club must be notified of cancellation as soon as possible prior to the booking.
4.2 Cancellation Fees & Refunds
Should the Hirer cancel their booking, the Club will retain the deposit and refund the balance of the monies paid. The deposit may be used to reschedule the booking.
4.3 Cancellation by Eildon Croquet Club
The Hirer (casual and regular) will be notified as soon as possible if an occurrence beyond the control of the Eildon Croquet Club prevents access to or use of the Clubhouse and/or Courts. In these circumstances, all monies paid will be refunded.
5. Conditions of Use of the Clubhouse, Courts & Club-Owned Equipment
5.1 Children
Children attending the Croquet Club are the responsibility of the Hirer and must be supervised for the duration of the booking.
5.2 Prohibited Substances
The Hirer is not permitted to have the following substances on the premises (including lawns & surrounds):
• fireworks
• glitter, rice, confetti
• smoke- or sparkler-machines or similar
• open flames, including fire-pits (use of gas BBQ permitted)
5.3 Cleaning
Hirers must leave the Clubhouse in a clean state at the conclusion of their booking. Please place recyclables in the appropriate recycling bin, and any “containers for cash” items in the appropriate bins.
5.4 Clubhouse Equipment
Eildon Croquet Club endeavours to ensure that all equipment in the Clubhouse is
maintained and in good working order.
All electrical equipment is tested annually in accordance with required legislation and standards.
5.5 Catering & Food Preparation
BBQs, spits or cooking appliances with open flames are not permitted inside the
Clubhouse.
The Hirer may use Club kitchen appliances & other fixtures, crockery, cutlery, etc.
5.6 Smoking
Smoking and vaping are not permitted within the premises, including the Clubhouse, Courts, shelters & surrounds.
5.7 Damages & Repairs
Any damage to furniture or equipment must be reported to the Club as soon as possible. Cost of repairs will be determined by Eildon Croquet Club and the Hirer may be liable for the costs if caused through misuse, negligence or disregard for safety.
5.8 Animals
Animals are not permitted at the Club unless written approval has been received from
Eildon Croquet Club. Assistance animals allowed.
5.9 Use of the Clubhouse & Courts
The Hirer is responsible for the behaviour of persons using the Clubhouse and Courts.
No glassware is to be taken onto the Courts.
Flat-soled footwear must be worn on the Courts to limit damage to Court surfaces.
5.10 Opening & Lockup
Eildon Croquet Club will be responsible for opening the Clubhouse and Courts and for
locking up at the conclusion of the event.
6. Risk Management
6.1 General
All accidents, injuries and incidents must be reported to Eildon Croquet Club within 24
hours of the event occurring. Any accident, injury or incident that results in a person being taken to hospital must be reported immediately to Eildon Croquet Club.
6.2 Risk Prevention
The Hirer is required to:
• ensure all spillages on floors are mopped and cleaned to prevent any slips, trips or falls
• keep doorways, passages, and exits unobstructed
• familiarise themselves with safety requirements & instructions, including location of the AED (Automated External Defibrillator) and emergency evacuation point
6.3 First Aid
If urgent medical attention is required, call 000. The street location of the Club is 75 Oxley Avenue, Woody Point, 4019.
7. Indemnity & Insurance
The Hirer and Eildon Croquet Club agree as follows:
The Hirer uses and occupies the Clubhouse and/or Courts at the risk of the Hirer, and the Hirer will release Eildon Croquet Club from all actions, claims and demands of every kind resulting from:
• any accident, loss, damage or injury to any person or property occurring in the Clubhouse or on the Courts whilst occupied or used by the Hirer; except where the actions, claim or demand is a result of the negligence or omissions on the part of Eildon Croquet Club Inc.
• any accident, loss, damage or injury to any person or property arising out of the use of the equipment provided by Eildon Croquet Club pursuant to the hire of the Clubhouse and/or Courts, except where the action, claim or demand is a result of the negligence or omissions on the part of the Eildon Croquet Club.
Eildon Croquet Club Inc. has Public Liability Insurance to the value of $20M.
